According to Active Screening there is currently no state or federal law that requires a criminal background check on local Saint Nic’s. Currently, it is up to each specific organization to decide whether or not they would like to pre-screen someone before hiring them to play the role of Santa Claus. Due to the fact that the role requires countless interactions with young children, wouldn’t you want to know the history behind the man you’re going to call Santa?
